FLAC clarifies how the Habitual Residence Condition is to be applied to asylum seekers

The Free Legal Advice Centre (FLAC) has issued a briefing note clarifying how social welfare law is to be applied in establishing the Habitual Residence Condition (HRC). Asylum seekers as a group were being excluded from accessing social welfare, but following some positive decisions from the Chief Social Welfare Appeals Officer, asylum seekers will no longer be categorically exempt from qualifying for social welfare and may in some circumstances be considered for receiving these payments.
